Can an F1 student applies for Green Card?
So my question is, if I do have legal working status through CPT, can an F1 student applies for Green Card without having H1-B first? I got my F1 visa and entered the US in 1998 to get my Bachelor degree. I have the visa renew in 2003 and entered a graduate school since then. I got my Master degree in 2007 and my OPT was issued on March 10, 2007 to March 10, 2008. I've been working in the US since April 16, 2007 as a software engineer. My company is pretty nice and supportive. They know my status and they are willing to file H1-b as well as green card for me. But there is a problem. My OPT is expired on March 10, 2008 and even with the new OPT extension to students whose majors are science, math...etc, the new rule doesn't apply to me. So I went back to the school I graduated from and apply for their MBA program in exchange to get CPT, the legal off-campus working status. They even gave me 40 hours per week than the normal 20 hours to help me get through the tough time. My company then applies H1-b for me in April. However, during the processing, I guess I have bad luck or something, they mess up my application with other because I have a really common name. They request more documents that we don't have, such as company license in a state that we're not even have branch there. They ask for Los Angeles business license that we're currently located, but for some reasons that I don't know why, we don't have it (our headquarter is based in other state). So our HR people did apply for it, but up to the deadline Aug 15, we haven't received it. The attorney sent whatever we have to USCIS anyway. There is a chance that my application will be denied. Even the company will help me file the H1-b again next year, but with more and more people apply for it, there is chance that I won't get it next year also. And I don't want to pay the school international student tuition for something classes I'm not interested either. I don't think I can go through the H1-b process again for a non-guarantee outcome.
